5510.0810 AUTHORIZATION SIGNATURES.

Subpart 1.

Confidentiality.

Authorization signatures submitted in support of a petition are privileged and confidential information and may only be withdrawn by the petitioner.

Subp. 2.

Valid authorization signatures.

A.

Authorization signatures must be in the form of individual authorization cards and include:

(1)

a statement reflecting the employee's support for the petition's purpose;

(2)

the legibly printed name of the employee making the authorization;

(3)

the employee's signature; and

(4)

the date the employee signed the card.

B.

Authorization cards may contain the employee organization's name, address, e-mail address, and telephone number.

Subp. 3.

Invalid authorization card.

An authorization card is invalid if it:

A.

does not include the information and statements required under subpart 2;

B.

contains statements of explanation, interpretation, or advice;

C.

is modified or altered in any way; or

D.

is dated more than six months before the commissioner receives the petition.

Subp. 4.

Effect of invalid authorization card.

A.

The commissioner may not include invalid authorization cards when determining whether a petition has the necessary showing of interest.

B.

If there is evidence that authorization cards submitted to establish a showing of interest were fraudulently obtained or submitted:

(1)

the petition or intervention must be denied; and

(2)

a one-year election bar for that unit must be applied to the party submitting fraudulent cards.
