Listed below are the topics and preliminary dates for the Revisor’s Office series of continuing legal education seminars. The Revisor’s Office offers free CLEs during the legislative interim, usually in the months of September through January. The seminars are free and open to the public. Pre-registration is not required unless noted. Room locations in the State Office Building or Minnesota Senate Building are subject to change depending on legislative hearing schedules. Rulemaking and Legislative Oversight

The Office of the Revisor of Statutes provides administrative rule drafting services to agencies, assisting them in proposing and adopting rules that are written clearly and concisely, consistent with legislative direction, and free of drafting errors. Under Senate Rule 4.5, a bill that authorizes rulemaking must be referred to the Committee on State and Local Government before passage. The office of Senate Counsel provides counsel to legislators when evaluating a provision in a bill that authorizes rulemaking and to the committees with rulemaking oversight. The presenters from each office will explain the unique legal considerations involved in the rulemaking process.

The Minnesota Indian Family Preservation Act and the federal Indian Child Welfare Act

This presentation will examine the historical, cultural, and legal requirements of the federal Indian Child Welfare Act and the impetus for merging ICWA provisions into the Minnesota Indian Family Preservation Act. The federal Indian Child Welfare Act (ICWA) of 1978 established child protection procedures and requirements for children who are members of or eligible for membership in a federally recognized Tribe. In 2023, the Minnesota legislature enacted changes to the Minnesota Indian Family Preservation Act (MIFPA), which was first enacted in 1985 and had incorporated ICWA requirements. This CLE will discuss the 2023 legislation, other legislative proposals, relevant case law, and recent challenges to the constitutionality of ICWA in the Supreme Court of the United States
