4626.0415 SPECIALIZED PROCESSING VARIANCE REQUIREMENTS. 3-502.11

A food establishment must obtain a variance from the regulatory authority as specified in parts 4626.1690 to 4626.1700 before:

A.

smoking food as a method of food preservation rather than as a method of flavor enhancement;_P2

B.

curing food;_P2

C.

using food additives or adding components, such as vinegar:

(1)

as a method of food preservation rather than as a method of flavor enhancement;_P2 or

(2)

to render a food so that it is not TCS;_P2

D.

packaging TCS food using a reduced oxygen packaging method except where the growth of and toxin formation by Clostridium botulinum and the growth of Listeria monocytogenes are controlled as specified in part 4626.0420;_P2

E.

operating a molluscan shellfish life-support system display tank used to store and display shellfish that are offered for human consumption;_P2

F.

custom processing game animals that are for personal use as food and not for sale or service in a food establishment and not under USDA or "state equal to" inspections;_P2

G.

sprouting seeds or beans;_P2 or

H.

preparing food by any method that is not in compliance with this Code._P2
