353G.12 SURVIVOR BENEFIT.
Subdivision 1.Entitlement.
(a) A survivor of a deceased active member of the retirement plan or a deceased deferred member of the retirement plan, upon application as prescribed by the executive director, is entitled to receive a survivor benefit.
(b) A survivor is the spouse of the member, or if none, the minor child or children of the member, or if none, the estate of the member.
Subd. 2.Lump-sum retirement plan; survivor benefit amount.
The amount of the survivor benefit for the lump-sum retirement division is the amount of the lump-sum service pension that would have been payable to the member of the lump-sum retirement division on the date of death if the member had been age 50 or older on that date.
Subd. 3.Monthly benefit retirement plan; survivor benefit amount.
The amount of the survivor benefit for the monthly benefit retirement division is the survivor service pension amount specified in the retirement benefit plan document applicable to the fire department, subject to all conditions and limitations for the benefit specified therein.
