     144.9509 Enforcement. 

    Subdivision 1.    Enforcement.  When the commissioner 
 exercises authority for enforcement, the provisions of sections 
 144.9501 to 144.9509 shall be enforced under the provisions of 
 sections 144.989 to 144.993.  Boards of health shall enforce a 
 lead order issued under section 144.9504 under a local ordinance 
 or as a public health nuisance under chapter 145A. 

    Subd. 2.    Discrimination.  A person who discriminates 
 against or otherwise sanctions an employee who complains to or 
 cooperates with the assessing agency in administering sections 
 144.9501 to 144.9509 is guilty of a petty misdemeanor.  

    Subd. 3.    Enforcement and status report.  The 
 commissioner shall examine compliance with Minnesota's existing 
 lead standards and rules and report to the legislature 
 biennially, beginning February 15, 1997, including an evaluation 
 of current lead program activities by the state and boards of 
 health, the need for any additional enforcement procedures, 
 recommendations on developing a method to enforce compliance 
 with lead standards, and cost estimates for any proposed 
 enforcement procedure.  The report shall also include a summary 
 of lead surveillance data collected by the commissioner.
