124D.62 EXEMPTION FROM LICENSURE REQUIREMENTS FOR LIMITED
ENGLISH PROFICIENCY (LEP) OR ENGLISH AS A SECOND LANGUAGE (ESL)
TEACHERS.
    Subdivision 1. Exemptions. The commissioner may grant an exemption from the licensure
requirement in the hiring of teachers of English as a second language or bilingual education
teachers to a district if the commissioner finds that compliance would impose a hardship upon
the district in the securing of teachers for its educational programs for limited English proficient
students. The commissioner shall notify the Board of Teaching of any exemptions granted
pursuant to this section.
    Subd. 2. Granting a license. A teacher serving under an exemption as provided in
subdivision 1 shall be granted a license as soon as that teacher qualifies for it. Not more than one
year of service by a teacher under an exemption shall be credited to the teacher for the purposes
of section 122A.40. For purposes of section 122A.41, a teacher shall receive credit equal to the
number of years the teacher served under an exemption.
