     169.901 Employment of intemperate driver.  

    No person owning or having control of a coach or vehicle 
 traveling upon any road for the conveyance of passengers shall 
 employ any person to drive the same who is addicted to the 
 excessive use of intoxicating liquors.  

    Every person who violates any provision of this section 
 shall forfeit for each offense such sum as the court shall fix, 
 not exceeding $50 and be liable to any party injured for all 
 damages sustained by reason of such offense; provided, that 
 complaint for such violation be made within three months, and 
 every action for damages shall be begun within one year, 
 thereafter.
