     62A.25 Reconstructive surgery. 

    Subdivision 1.  This section applies to all policies of 
 accident and health insurance, health maintenance contracts 
 regulated under chapter 62D, health benefit certificates offered 
 through a fraternal benefit society regulated under chapter 64B, 
 and group subscriber contracts offered by nonprofit health 
 service plan corporations regulated under chapter 62C but does 
 not apply to policies designed primarily to provide coverage 
 payable on a per diem, fixed indemnity or nonexpense incurred 
 basis, or policies that provide only accident coverage. 

    Subd. 2.  Every policy, plan, certificate or contract to 
 which this section applies shall provide benefits for 
 reconstructive surgery when such service is incidental to or 
 follows surgery resulting from injury, sickness or other 
 diseases of the involved part or when such service is performed 
 on a covered dependent child because of congenital disease or 
 anomaly which has resulted in a functional defect as determined 
 by the attending physician.
