8420.0315 NO-LOSS APPLICATIONS.

A.

A landowner may apply to the local government unit for a no-loss decision. A landowner who does not request a decision from the local government unit and proceeds with the activity may be subject to the enforcement provisions under part 8420.0915 and Minnesota Statutes, section 103G.2372.

B.

The landowner applying for a no-loss is responsible for submitting the proof necessary to show qualification for the claim. This part also applies to applications requesting a decision on whether an activity or wetland falls within the scope of this chapter.
