7414.1470 GENERAL CRITERIA FOR GRANTING WAIVER.

The commissioner shall grant a waiver if:

A.

the waiver was requested in the manner prescribed by parts 7414.1410 to 7414.1460;

B.

the waiver will have no potential adverse effect on public or pupil safety;

C.

any alternative measures; the modification of policies, practices, or procedures; or the provision of auxiliary aids or services, if any, are equivalent or superior to those prescribed in rules; and

D.

the waiver does not waive a statutory standard.
