7190.0012 CLAIM DISMISSAL.

The Pollution Control Agency may dismiss a claim when:

A.

the claimant refuses to supply requested information, including undergoing mental or physical examination;

B.

the claimant receives an award from the responsible person;

C.

the claimant has falsified or withheld information relevant to the claim; or

D.

the claimant refuses to appear before the agency when ordered.
