7045.0645 AIR EMISSION STANDARDS FOR TANKS, SURFACE IMPOUNDMENTS, AND CONTAINERS.

Subpart 1.

Incorporation of federal regulations.

The owners and operators of interim status facilities that treat, store, or dispose of hazardous waste in tanks, surface impoundments, or containers must comply with Code of Federal Regulations, title 40, part 265, subpart CC, air emission standards for tanks, surface impoundments, and containers, sections 265.1080 to 265.1091, as amended, which are incorporated by reference subject to the exceptions in subpart 2.

Subp. 2.

Additions, modifications, or exceptions to incorporated regulations.

A.

The agency does not incorporate the following Code of Federal Regulations, title 40, part 265, subpart CC, provisions, as amended:

(1)

Code of Federal Regulations, title 40, section 265.1080(d) to (g), governing specific exclusions; and

(2)

Code of Federal Regulations, title 40, section 265.1083(c)(4)(ii), governing authority that EPA cannot delegate to states.
