7007.3000 PREVENTING SIGNIFICANT DETERIORATION OF AIR QUALITY.

A.

Code of Federal Regulations, title 40, part 52.21, as amended, entitled "Prevention of Significant Deterioration of Air Quality," is incorporated by reference, except that:

(1)

the authorities identified in Code of Federal Regulations, title 40, part 52.21 (g), (s), (t), and (u), are not delegated to the commissioner and are retained by the administrator; and

(2)

the commissioner must comply with parts 7007.0700, item B, and 7007.0850, subpart 2, in lieu of the requirements under Code of Federal Regulations, title 40, part 52.21 (q).

B.

Any person who constructs, modifies, reconstructs, or operates an emissions unit, emission facility, or stationary source must meet the requirements of Code of Federal Regulations, title 40, part 52.21.

C.

All applications and other information required pursuant to Code of Federal Regulations, title 40, part 52.21, from emissions units, emission facilities, and stationary sources located in Minnesota must be submitted to the commissioner.
