Mining shall be conducted to maximize use of past, present, and future mining areas so as to minimize the amount of land disturbed by mining and reduce the loss of nonmineral resources.
The commissioner may require in-mine disposal of mine waste.
Mining methods and schedules shall be used which provide areas for waste disposal at the earliest opportunity.
The commissioner will consider factors such as the following to determine the extent to which in-mine disposal shall be required:
the ease of reclamation;
public safety and welfare;
natural resource preservation;
land use demands;
ownership of the minerals;
mineral resource values; and
physical and economic feasibility.
