4731.2620 REPORTS; RADIATION EXPOSURES, LEVELS, AND CONCENTRATIONS EXCEEDING CONSTRAINTS OR LIMITS.

Subpart 1.

Reportable events.

In addition to the notification required under part 4731.2610, a licensee must submit a written report within 30 days after learning of:

A.

an incident for which notification is required under part 4731.2610;

B.

doses in excess of:

(1)

the occupational dose limits for adults under part 4731.2020;

(2)

the occupational dose limits for a minor under part 4731.2070;

(3)

the limits for an embryo/fetus of a declared pregnant woman under part 4731.2080;

(4)

the limits for an individual member of the public under part 4731.2090;

(5)

any applicable limit in the license; or

(6)

the ALARA constraints for air emissions established under part 4731.2010, subpart 4;

C.

levels of radiation or concentrations of radioactive material in:

(1)

a restricted area in excess of applicable limits in the license; or

(2)

an unrestricted area in excess of ten times any applicable limit under this chapter or in the license, whether or not involving exposure of any individual in excess of the limits under part 4731.2090; or

D.

for licensees subject to the provisions of the Environmental Protection Agency's generally applicable environmental radiation standards under Code of Federal Regulations, title 40, part 190, levels of radiation or releases of radioactive material in excess of those standards or of license conditions related to those standards.

Subp. 2.

Contents of reports.

A report required under subpart 1 must describe the extent of exposure of individuals to radiation and radioactive material, including, as appropriate:

A.

estimates of each individual's dose;

B.

the levels of radiation and concentrations of radioactive material involved;

C.

the cause of the elevated exposures, dose rates, or concentrations; and

D.

corrective steps taken or planned to ensure against a recurrence, including the schedule for achieving conformance with applicable limits, ALARA constraints, generally applicable environmental standards, and associated license conditions.

Subp. 3.

Individual information.

A.

A report filed under subpart 1 must include, for each occupationally overexposed individual:

(1)

the name; and

(2)

date of birth.

B.

With respect to the limit for the embryo/fetus under part 4731.2080, the identifiers must be those of the declared pregnant woman.

C.

The report must be prepared so that the information under this subpart is stated in a separate and detachable part of the report.

Subp. 4.

Reporting method.

All licensees, other than those holding an operating license for a nuclear power plant, who make reports according to this part must submit the report in writing to the commissioner according to part 4731.2610.
