4720.5250 OBJECTIVES AND PLAN OF ACTION.

Subpart 1.

Objectives.

A wellhead protection plan must have measurable objectives for the well and drinking water supply management area.

Subp. 2.

Plan of action.

A wellhead protection plan must state a plan of action. A plan of action must:

A.

address the problems and opportunities identified in the wellhead protection plan;

B.

identify and prioritize the wellhead protection measures that will be used;

C.

identify proposed changes in well construction, maintenance, and use; and

D.

identify a time frame for the implementation of the action identified in the plan.

Subp. 3.

Establishing priorities.

A public water supplier must establish priorities in the plan of action that:

A.

address:

(1)

any substance that exceeds the maximum contaminant level specified in Code of Federal Regulations, title 40, part 141 (1995 and as subsequently amended); and

(2)

a quantifiable level of a contaminant in the well water resulting from human activity; and

B.

reflect:

(1)

the number of each potential contaminant source identified and the nature of the potential contamination associated with each source;

(2)

the location of each potential contaminant source in relation to:

(a)

the public water supply well;

(b)

the isolation distances; and

(c)

a one-year time of travel emergency response time;

(3)

the capability of the geologic material to absorb a contaminant;

(4)

the effectiveness of existing controls;

(5)

the time required to obtain cooperation from other public water suppliers, and local, state, and federal agencies and programs; and

(6)

the administrative, legal, technical, and public and private financial resources needed.

Subp. 4.

Implementation responsibilities.

A plan of action must:

A.

describe those actions that will be taken by the public water supplier alone;

B.

describe those actions that will require the cooperation of a local unit of government or state and federal agencies; and

C.

state whether the public water supplier has received commitments for the cooperation described in item B.
