4714.0101 CONFORMANCE WITH CODE.

Subpart 1.

Scope.

As provided in Minnesota Statutes, sections 326B.43 and 326B.52, this code applies to all new plumbing installations performed anywhere in the state, including additions, extensions, alterations, and replacements.

Subp. 2.

New buildings.

In new buildings, all plumbing materials and plumbing systems or parts thereof shall be installed to meet the minimum provisions of this code.

Subp. 3.

Existing buildings.

In existing buildings and premises in which plumbing systems, drainage systems, or other work regulated by this code are to be added, altered, renovated, or replaced, the new materials and work shall meet the provisions of this code. If the Authority Having Jurisdiction finds that the full performance of bringing the work into compliance with all requirements of this code would result in exceptional or undue hardship by reason of excessive structural or mechanical difficulty or impracticability, a deviation may be granted by the Authority Having Jurisdiction only to the extent the deviation can be granted without endangering the health and safety of the occupants and the public.

Subp. 4.

Changes in building occupancy.

A plumbing system that is a part of a building or structure undergoing a change in use or occupancy, as defined in the building code, shall be in accordance with the requirements of this code that are applicable to the new use or occupancy.

Subp. 5.

Moved buildings.

Plumbing systems that are part of buildings or structures moved into this jurisdiction shall be in accordance with this code for new installations. Parts of the plumbing systems of a building or part thereof that is moved from one foundation to another, or from one location to another, shall be completely tested as new work, except that walls or floors need not be removed during such tests where other equivalent means of inspection acceptable to the Authority Having Jurisdiction are provided.

Subp. 6.

Health and safety.

No provision of this code shall be deemed to require a change in a portion of a plumbing or drainage system or other work regulated by this code in or on an existing building or lot where the work was installed and is maintained in accordance with rule in effect before the effective date of this code. Where the plumbing or drainage system or other work regulated by this code is determined by the Authority Having Jurisdiction to be dangerous, unsafe, insanitary or a nuisance or a hazard to life, health, or property then the owner or owner's agent shall be responsible for bringing the existing plumbing installation within the provisions of this code. Where these conditions exist, the owner or owner's agent shall be responsible for installing additional plumbing or making such corrections as may be necessary to abate such nuisance or hazard and bring the existing plumbing installation within the provisions of this code.

Subp. 7.

Commissioner's authority.

The commissioner retains the ultimate authority to enforce this code and Minnesota Statutes, sections 326B.41 to 326B.59, regardless of whether the administrative authority is the commissioner or the governing body of a governmental subdivision.
