For the purposes of determining the presence of sexual misconduct:
a person is considered to remain an active patient until no less than two years have elapsed since the last date on which the chiropractor examined or treated the patient; and
the conduct must occur at the time of or subsequent to the provision of an initial examination or treatment.
Consent or mutual consent may not be used by the chiropractor in the defense of an allegation of sexual misconduct by the chiropractor.
