                         CHAPTER 73-H.F.No. 620 
           An act relating to state lands; authorizing the sale 
          of certain land in Cook county; authorizing the 
          private sale of certain state lands in St. Louis 
          county. 
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
     Section 1.  [COOK COUNTY; LAND SALE.] 
    (a) Notwithstanding Minnesota Statutes, section 282.018, 
Cook county may sell the lands bordering public waters described 
in paragraph (c) in accordance with the remaining provisions of 
Minnesota Statutes, chapter 282. 
    (b) The conveyance must be in a form approved by the 
attorney general. 
    (c) The lands that may be sold are located in Cook county 
and are described as: 
    (1) Government Lot 1, Section 20, Township 61 North, Range 
2 West; and 
    (2) Government Lot 5 north of the Gunflint Trail, Section 
33, Township 65 North, Range 3 West. 
    (d) The county has determined that the county's land 
management interests would best be served if the lands were 
privately owned. 
    Sec. 2.  [ST. LOUIS COUNTY; PRIVATE SALE.] 
    (a) Notwithstanding Minnesota Statutes, section 92.45, the 
commissioner of natural resources may offer for sale and sell, 
in the manner provided for the sale of other trust fund lands, 
the land described in paragraph (c), except that the value of 
the improvements on the land shall be appraised separately.  The 
conveyance must be in a form approved by the attorney general. 
    (b) If at the sale of the land Duane D. Cihlar is the 
purchaser, he is not required to pay for the improvements upon 
furnishing an affidavit showing that the improvements were owned 
by him. 
    If a person other than Duane D. Cihlar purchases the land, 
the purchaser shall pay in cash to the state at the time of 
sale, in addition to all other required payments, the full 
amount for which the improvements are appraised.  The amount 
received by the state for the improvements must be paid by the 
state treasurer, with the approval of the commissioner of 
finance, to Duane D. Cihlar or his successor in interest as 
compensation for the improvements.  The money required for the 
payment is appropriated for this purpose. 
    (c) The commissioner may offer for sale and sell the land 
described as: 
    That part of the North 110 feet of the Southwest Quarter of 
the Northeast Quarter of Section 4, Township 61 North, Range 12 
West, St. Louis county, Minnesota, lying westerly of the 
unnamed creek, containing 2.6 acres, more or less. 
    (d) This land sale will resolve an inadvertent trespass 
revealed by a recent survey.  The public interest will be best 
served when this trespass is resolved. 
    Sec. 3.  [EFFECTIVE DATE.] 
    This act is effective the day following final enactment.
