Laws of Minnesota 1983 CHAPTER 191--H.F.No. 794 An act relating to the legislature; enacting the present legislative apportionment into statutory form with minor alterations; amending Minnesota Statutes 1982, sections 2.021; 2.031; proposing new law coded in Minnesota Statutes, chapter 2; and repealing Minnesota Statutes 1982, sections 2.041 to 2.712. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: Section 1. [2.019] [APPORTIONMENT.] Subdivision 1. [ADOPTION.] The apportionment of legislative districts by the United States district court for the district of Minnesota in LaComb v. Growe, 4-81 Civ 152, is adopted with the adjustments in subdivision 2. Subd. 2. [ADJUSTMENTS.] Appendix A of the court's order is adjusted to include that portion of Dakota county consisting of the portion of the city of South St. Paul in ward two precinct three, census tract 602.02, blocks 305, 306, and 309 in distict 39A instead of district 39B, and to include that portion of Dakota county consisting of the city of South St. Paul in ward one precinct three, census tract 603.02, blocks 113, 208, 215, and 414 in district 39B instead of district 39A. Sec. 2. [INSTRUCTION TO REVISOR.] The revisor of statutes shall code metes and bounds descriptions of the legislative districts adopted in section 1 into Minnesota Statutes. Sec. 3. Minnesota Statutes 1982, section 2.021, is amended to read: 2.021 [NUMBER OF MEMBERS.] For each legislature, until a new apportionment shall have been made, the senate is composed of 67 members and the house of representatives is composed of135134 members. Sec. 4. Minnesota Statutes 1982, section 2.031, is amended to read: 2.031 [APPORTIONMENT.] Subdivision 1. [LEGISLATIVE DISTRICTS.] The representatives in the senate and house of representatives are apportioned throughout the state in 67legislativesenate districts and 134 house districts. Each senate district is entitled to elect one senator and each house district is entitled to elect one representative. Subd. 2. [DEFINITION.] Thetermterms "county," "townor," "township," "city, ward, precinctor election precinct," "census tract," "block," and "unorganized territory" when used in a description of a districtwhich is apportioned by thisact meansin subdivision 1 means a geographical area established as such by law and as it existedon the date this act becameeffectivefor purposes of the 1980 federal census. Sec. 5. [REPEALER.] Minnesota Statutes 1982, sections 2.041; 2.051; 2.061; 2.071; 2.081; 2.091; 2.101; 2.111; 2.121; 2.131; 2.141; 2.151; 2.161; 2.171; 2.181; 2.191; 2.201; 2.211; 2.221; 2.231; 2.241; 2.251; 2.261; 2.271; 2.281; 2.291; 2.301; 2.311; 2.321; 2.331; 2.341; 2.351; 2.361; 2.371; 2.381; 2.391; 2.401; 2.411; 2.421; 2.431; 2.441; 2.451; 2.461; 2.471; 2.481; 2.491; 2.501; 2.511; 2.521; 2.531; 2.541; 2.551; 2.561; 2.571; 2.581; 2.591; 2.601; 2.611; 2.621; 2.631; 2.641; 2.651; 2.661; 2.671; 2.681; 2.691; 2.701; 2.711; and 2.712 are repealed. Sec. 6. [SEVERABILITY.] If the adjustments in legislative districts in section 1, subdivision 2, are adjudicated to be a new apportionment so as to require an election of senators before 1986, section 1, subdivision 2, is void. Sec. 7. [EFFECTIVE DATE.] This act is effective for the elections of members of the legislature in 1984 for the 1985 regular session and thereafter. Approved May 19, 1983
