A bill for an act
relating to health-related occupations; providing an exception for continuing
education requirements for licensed professional counselors; amending
Minnesota Statutes 2008, section 148B.54, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 148B.54, is amended by adding a
subdivision to read:

new text begin An individual who was
issued a license as a professional counselor on November 1, 2004, and whose license was
terminated on February 20, 2009, shall be eligible for license renewal without complying
with the continuing education requirements during the first four years of licensure as
required by Minnesota Rules, part 2150.2520, subpart 4, or the continuing education
requirement for relicensure following termination in Minnesota Rules, part 2150.0130,
subpart 2. The individual must show that at the time of license termination, except for
failure to meet the continuing education requirement for renewal, there was no disciplinary
action pending against the licensee. Upon relicensure, the individual must complete at
least 20 continuing education credits within one year of the renewal date.
