1.1A bill for an act 1.2relating to health-related occupations; denying chiropractic license to a person 1.3convicted of a felony-level sexual conduct offense; providing an exception 1.4for continuing education requirements for licensed professional counselors; 1.5amending Minnesota Statutes 2008, sections 148.10, by adding a subdivision; 1.6148B.54, by adding a subdivision. 1.7BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.8    Section 1. Minnesota Statutes 2008, section 148.10, is amended by adding a 1.9subdivision to read: 1.10     new text begin Subd. 1b. new text end new text begin Conviction of a felony-level criminal sexual conduct offense. new text end new text begin (a) new text end 1.11 new text begin The board may not grant a license to practice chiropractic to any person who has been new text end 1.12 new text begin convicted of a felony-level sexual conduct offense. new text end 1.13 new text begin (b) A license to practice chiropractic is automatically revoked if the licensee is new text end 1.14 new text begin convicted of a felony-level criminal sexual conduct offense. new text end 1.15 new text begin (c) A license that has been denied or revoked pursuant to this subdivision is not new text end 1.16 new text begin subject to chapter 364. new text end 1.17 new text begin (d) For purposes of this subdivision, "conviction" means a plea of guilty, a verdict of new text end 1.18 new text begin guilty by a jury, or a finding of guilty by the court, and "criminal sexual conduct offense" new text end 1.19 new text begin means a violation of sections 609.342 to 609.345 or a similar statute in another jurisdiction. new text end 1.20    Sec. 2. Minnesota Statutes 2008, section 148B.54, is amended by adding a subdivision 1.21to read: 1.22     new text begin Subd. 3. new text end new text begin Exception to continuing education requirement. new text end new text begin An individual who was new text end 1.23 new text begin issued a license as a professional counselor on November 1, 2004, and whose license was new text end 1.24 new text begin terminated on February 20, 2009, shall be eligible for license renewal without complying new text end 2.1 new text begin with the continuing education requirements during the first four years of licensure as new text end 2.2 new text begin required by Minnesota Rules, part 2150.2520, subpart 4, or the continuing education new text end 2.3 new text begin requirement for relicensure following termination in Minnesota Rules, part 2150.0130, new text end 2.4 new text begin subpart 2. The individual must show that at the time of license termination, except for new text end 2.5 new text begin failure to meet the continuing education requirement for renewal, there was no disciplinary new text end 2.6 new text begin action pending against the licensee. Upon relicensure, the individual must complete at new text end 2.7 new text begin least 20 continuing education credits within one year of the renewal date. new text end
