A bill for an act
relating to watershed districts; setting the requirements for request by residents
of a watershed district for an audit of a watershed district by the state auditor;
amending Minnesota Statutes 2004, section 103D.355, subdivision 2.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2004, section 103D.355, subdivision 2, is amended to
read:
(a) If the annual audit is to be made by the
state auditor, the audit must be initiated by a petition new text begin bearing the names of 100 new text end of the
resident owners of the watershed district or resolution of the managers of the watershed
districtnew text begin , except that if there are fewer than 500 resident owners of the watershed district,
the petition must bear the names of 25 of the resident owners of the watershed districtnew text end .
The petition new text begin or resolution new text end must request an annual audit pursuant to the authority granted
municipalities under sections 6.54 and 6.55.new text begin This paragraph supersedes any inconsistent
provision of section 6.54.new text end
(b) If the audit is made by the state auditor, the watershed district receiving the
examination must pay the state the total cost and expenses of the examination, including
the salaries paid to the examiners while actually engaged in making the examination.
The general fund must be credited with all collections made for examinations under this
subdivision.
