4E Relating to vulnerable adults; authorizing disclosure of financial
information to law enforcement, lead agencies or prosecuting authorities
investigating financial exploitation of vulnerable adults in response to
judicial or administrative subpoena; authorizing local agencies under medical
assistance (MA) to grant hardship waivers of periods of ineligibility due to
imminent threat to health and well-being and requiring local agencies to
consider financial exploitation, fraud or theft; requiring the criminal alert
network to disseminate data on vulnerable adults; authorizing county attorney
administrative subpoena issuance for vulnerable adult banking and financial
records; clarifying financial exploitation of vulnerable adult; expanding
criminal code theft provisions to include vulnerable adult financial
exploitation; requiring a speedy trial in criminal proceedings; authorizing
boarding care homes, nursing homes and hospitals to submit electronic reports;
defining person; requiring financial institution cooperation, providing for
immunity from liability; requiring agency coordination and commissioners of
health and public safety under human services commissioner to consult community
representatives and requiring agencies guidelines development; establishing a
vulnerable adult financial exploitation cause of action; modifying vulnerable
adult definition; requiring the commissioner of human services to seek federal
funding to design, implement and evaluate the common entry point for reports of
suspected maltreatment with a statewide toll-free telephone number and web
site-based system
