An act

relating to commerce; changing requirements for motor vehicle service contracts;

amending Minnesota Statutes 2016, section 59B.02, subdivision 11, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2016, section 59B.02, subdivision 11, is amended to read:

Subd. 11.

Service contract.

"Service contract" means a contract or agreement for a separately stated consideration for a specific duration to performnew text begin :new text end

new text begin (1)new text end the repair, replacement, or maintenance of property or indemnification for repair, replacement, or maintenance, for the operational or structural failure due to a defect in materials, workmanship, or normal wear and tear, with or without additional provisions for incidental payment of indemnity under limited circumstances, including without limitation, towing, rental, emergency road service, and road hazard protection. Service contracts may provide for the repair, replacement, or maintenance of property for damage resulting from power surges and accidental damage from handlingnew text begin ;new text end

new text begin (2) the repair or replacement of tires or wheels on a motor vehicle damaged as result of coming into contact with a road hazard; new text end

new text begin (3) the removal of dents on a motor vehicle that can be repaired using the process of paintless dent removal without affecting the existing paint finish or replacing vehicle body panels, sanding, bonding, or painting; new text end

new text begin (4) the repair of chips or cracks in a motor vehicle windshield or the replacement of a motor vehicle windshield as a result of damage caused by a road hazard; new text end

new text begin (5) the replacement of a motor vehicle key or key fob in the event that the key or key fob becomes inoperable or is lost or stolen; or new text end

new text begin (6) other services as approved by the commissionernew text end .

Sec. 2.

Minnesota Statutes 2016, section 59B.02, is amended by adding a subdivision to read:

new text begin Road hazard. new text end

new text begin "Road hazard" means a danger encountered while driving a motor vehicle including, but not limited to, potholes, rocks, weed debris, metal parts, glass, plastic, curbs, or composite scraps. new text end
