An act

relating to public safety; clarifying the offense of fourth degree assault against a peace officer;

amending Minnesota Statutes 2014, section 609.2231, subdivision 1.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2014, section 609.2231, subdivision 1, is amended to read:

Subdivision 1.

Peace officers.

new text begin (a) As used in this subdivision, "peace officer" means a person who is licensed under section 626.845, subdivision 1, and effecting a lawful arrest or executing any other duty imposed by law. new text end

new text begin (b) new text end Whoever physically assaults a peace officer deleted text begin licensed under section 626.845, subdivision 1, when that officer is effecting a lawful arrest or executing any other duty imposed by lawdeleted text end is guilty of a gross misdemeanor deleted text begin and may be sentenced to imprisonment for not more than one year or to payment of a fine of not more than $3,000, or bothdeleted text end .
