An act

relating to state government; exempting a person who performs threading from licensing; authorizing the good cause exemption for rulemaking;

amending Minnesota Statutes 2012, sections 155A.23, by adding a subdivision; 155A.27, subdivision 9; 155A.29, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2012, section 155A.23, is amended by adding a subdivision to read:

new text begin "Threading" is a method of removing hair from the eyebrows, upper lip, or other body parts by using cotton thread to pull hair from follicles. Threading does not include the use of chemicals or any type of wax. Threading may include the use of (1) over-the-counter astringents, gels, and powders; and (2) tweezers and scissors incidental to threading. new text end

Sec. 2.

Minnesota Statutes 2012, section 155A.27, subdivision 9, is amended to read:

Subd. 9.

Exemptions.

new text begin (a) new text end Persons licensed to provide cosmetology services in other states visiting this state for cosmetology demonstrations shall be exempted from the licensing provisions of sections 155A.21 to 155A.36 if services to consumers are in the physical presence of a licensed cosmetologist.

new text begin (b) A person who performs threading shall be exempt from the licensing provisions of sections 155A.21 to 155A.36. new text end

Sec. 3.

Minnesota Statutes 2012, section 155A.29, is amended by adding a subdivision to read:

new text begin The facility in which a person provides threading and no other services requiring licensure by this chapter is exempt from the requirement for a salon license under this section. new text end

Sec. 4.

new text begin RULEMAKING; THREADING. new text end

new text begin The Board of Cosmetologist Examiners shall amend Minnesota Rules, part 2105.0100, to exempt threading from the practice of cosmetology and classify it as an unregulated service. The board may use the good cause exemption under Minnesota Statutes, section 14.388, to adopt rules under this section, and Minnesota Statutes, section 14.386, does not apply except as provided under Minnesota Statutes, section 14.388. new text end
