An act relating to Hennepin county; removing certain
limitations on the county board's ability to lease
real property; removing limitations on the county
board's authority to construct off-street parking
facilities; amending Minnesota Statutes 2000, sections
383B.159; 383B.20, subdivision 1; repealing Minnesota
Statutes 2000, section 383B.20, subdivision 4.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1. Minnesota Statutes 2000, section 383B.159, is
amended to read:
383B.159 [REAL PROPERTY LEASES.]
The county board of commissioners of Hennepin county may
contract for the leasing of real property from individuals,
private or public corporations, or other governmental agencies
for a period of no longer than five years duration.
Sec. 2. Minnesota Statutes 2000, section 383B.20,
subdivision 1, is amended to read:
Subdivision 1. [ACQUISITION.] The county of Hennepin,
subject to the limitation imposed by subdivision 4, may use and
develop any property heretofore acquired or hereafter acquired
by gift, lease, purchase or condemnation proceedings, which
condemnation proceedings shall be in accordance with chapter
117, any real property within said county of Hennepin, or any
interest therein, deemed by the board of county commissioners to
be needed for the purposes of providing off-street parking
facilities in conjunction with any of the public buildings which
are under the control of the board of county commissioners for
county purposes. If the off-street parking facilities are not
acquired or bettered in conjunction with or primarily to serve
any of the public buildings which are under the control of the
board of county commissioners for county purposes, the
off-street parking project must be approved by the city council
of the city in which the facilities are to be located. The term
"off-street parking facilities" as used in this section includes
lots, lanes, garages, ramps or other structures and accessories.
Sec. 3. [REPEALER.]
Minnesota Statutes 2000, section 383B.20, subdivision 4, is
repealed.
Sec. 4. [EFFECTIVE DATE; LOCAL APPROVAL.]
Sections 1 to 3 are effective the day after August 1, 2002,
that is the day after the governing body of Hennepin county and
its chief clerical officer timely complete their compliance with
Minnesota Statutes, section 645.021, subdivisions 2 and 3.
