An act relating to natural resources; adding to and
deleting from state parks and state recreation areas;
redescribing a state park boundary and administration;
modifying administration of certain boathouse lot
leases in Soudan underground mine state park; amending
Minnesota Statutes 2000, section 85.012, subdivision
17; Laws 2000, chapter 486, section 4.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1. Minnesota Statutes 2000, section 85.012,
subdivision 17, is amended to read:
Subd. 17. Fort Ridgely state park, Nicollet county, which
is hereby renamed from Fort Ridgely memorial state park and
Renville counties.
Sec. 2. Laws 2000, chapter 486, section 4, is amended to
read:
Sec. 4. [BOATHOUSE LEASES; SOUDAN UNDERGROUND MINE STATE
PARK.]
(a) Notwithstanding Minnesota Statutes, sections 85.011;
85.012, subdivision 1; and 86A.05, subdivision 2, the leased
boathouse lots located at Stuntz bay in the Soudan underground
mine state park are extended for the lifetime of the current
leaseholder. The commissioner of natural resources shall not
cancel a lease, except for noncompliance with the lease
agreement.
(b) A lease, described under paragraph (a), may be
transferred only once by the current leaseholder to a person
within the third degree of kindred according to civil law or to
first cousins. When possession is transferred, the transferee
shall notify the commissioner and pay to the department of
natural resources an annual lease fee. The commissioner may
offer and, after agreement with the leaseholder, lease
equivalent alternative boathouse sites to a leaseholder.
(a) In 1965, United States Steel Corporation conveyed land
to the state of Minnesota that was included in the Soudan
underground mine state park, with certain lands at Stuntz Bay
subject to leases outstanding for employee boathouse sites.
(b) Notwithstanding Minnesota Statutes, sections 85.011,
85.012, subdivision 1, and 86A.05, subdivision 2, upon the
expiration of a boathouse lease described under paragraph (a),
the commissioner of natural resources shall offer a new lease to
the party in possession at the time of lease expiration, or, if
there has been a miscellaneous lease issued by the department of
natural resources due to expiration of a lease described under
paragraph (a), upon its expiration to the lessee. The new lease
shall be issued under the terms and conditions of Minnesota
Statutes, section 92.50, with the following limitations:
(1) the term of the lease shall be for the lifetime of the
party being issued a renewed lease and, if transferred, for the
lifetime of the party to whom the lease is transferred;
(2) the new lease shall provide that the lease may be
transferred only once and the transfer must be to a person
within the third degree of kindred or first cousin according to
civil law; and
(3) the commissioner shall limit the number of lessees per
lease to no more than two persons who have attained legal age.
At the time of the new lease, the commissioner may offer, and
after agreement with the leaseholder, lease equivalent
alternative sites to the leaseholder.
(c) The commissioner shall not cancel a boathouse lease
described under paragraphs (a) and (b) except for noncompliance
with the lease agreement.
(c) (d) By January 15, 2001, the commissioner of natural
resources shall report to the senate and house environment and
natural resources policy and finance committees on boathouse
leases in state parks. The report shall include information on:
(1) the number of boathouse leases;
(2) the number of leases that have forfeited;
(3) the expiration dates of the leases;
(4) the historical significance of the boathouses;
(5) recommendations on the inclusion of the land described
in paragraph (d) within the park boundary; and
(6) any other relevant information on the leases.
(d) (e) The commissioner of natural resources shall contact
U.S.X. Corporation and local units of government regarding the
inclusion of the following lands within Soudan underground mine
state park:
(1) all lands located South of Vermillion Lake shoreline in
Section 13, Township 62 North, Range 15 West;
(2) all lands located South of Vermillion Lake shoreline in
the S1/2-SE1/4 of Section 14, Township 62 North, Range 15 West;
(3) NE1/4-SE1/4 and E1/2-NE1/4 of Section 22, Township 62
North, Range 15 West;
(4) all lands located South of Vermillion Lake shoreline in
Section 23, Township 62 North, Range 15 West;
(5) all of Section 24, Township 62 North, Range 15 West;
(6) all lands North of trunk highway No. 169 located in
Section 25, Township 62 North, Range 15 West;
(7) all lands North of trunk highway No. 169 located in
Section 26, Township 62 North, Range 15 West;
(8) NE1/4-SE1/4 and SE1/4-NE1/4 of Section 27, Township 62
North, Range 15 West; and
(9) NW1/4 of Section 19, Township 62 North, Range 14 West.
Sec. 3. [ADDITIONS TO STATE PARKS.]
Subdivision 1. [85.012] [Subd. 4.] [BEAR HEAD LAKE STATE
PARK, ST. LOUIS COUNTY.] The following area is added to Bear
Head Lake state park, St. Louis county: the North Half of the
Northeast Quarter of Section 15, Township 61 North, Range 14
West.
Subd. 2. [85.012] [Subd. 12.] [CASCADE RIVER STATE PARK,
COOK COUNTY.] (a) The following areas are added to Cascade River
state park, all in Cook county:
(1) the North Half of the Southwest Quarter, the Southwest
Quarter of the Southwest Quarter, and the East Half of the
Southeast Quarter of the Southeast Quarter EXCEPT the westerly
155 feet of the South Half of the East Half of the Southeast
Quarter of the Southeast Quarter of Section 31; that part of the
Northeast Quarter of the Southwest Quarter that lies southerly
and southeasterly of county road No. 7 as it exists on January
13, 1976, of Section 32; the East 150 feet of Government Lot 4,
lying South of highway 61, of Section 33; all in Township 61
North, Range 1 West;
(2) the North Half of the Northwest Quarter of Section 1;
the Southwest Quarter of the Northeast Quarter, the Southeast
Quarter of the Northwest Quarter, the North Half of the
Southwest Quarter, and the Southwest Quarter of the Southwest
Quarter of Section 2; the East Half of the Northeast Quarter,
the North Half of the Northwest Quarter, the Southwest Quarter
of the Northwest Quarter, the Northwest Quarter of the Southwest
Quarter, the Southeast Quarter of the Southwest Quarter, and the
Southeast Quarter of Section 3; the Northeast Quarter of Section
9; the Northwest Quarter and the East 10 acres of the Southeast
Quarter of the Northeast Quarter of Section 10; all in Township
60 North, Range 2 West; and
(3) that part of the Southwest Quarter that lies southerly
and easterly of county road No. 45, and that part of the
Southwest Quarter of the Southeast Quarter that lies southerly
of county road No. 45 excepting therefrom that part of the
Southwest Quarter of the Southeast Quarter described as
follows: Commencing at the monument at the southwest corner of
said SW1/4 of SE1/4, thence east along the south boundary of
said SW1/4 a distance of 835 feet, and which is the point of
beginning (marked with an iron stake); thence North 120 feet,
more or less, to the centerline of Cook county road No. 45
(known as Pike Lake road); thence in a northwesterly direction
along the centerline of Cook county road No. 45 a distance of
580.0 feet, more or less, to the intersection with the
centerline of the former Babineau road; thence southeasterly
along the centerline of the former Babineau road a distance of
370 feet, more or less, to intersect with the south boundary of
said SW1/4 of SW1/4; thence East along the south boundary of
said SW1/4 of SE1/4 a distance of 325 feet, more or less, to the
point of beginning, containing approximately 1.9 acres, of
Section 24; the East Half, the South Half of the Southwest
Quarter, and that part of the Northwest Quarter that lies
southerly of county road No. 45 of Section 25; that part of the

(b) The commissioner of natural resources shall manage the
addition under paragraph (a) as a state park according to
Minnesota Statutes, section 86A.05, subdivision 2, and in
addition to other activities authorized in Cascade River state
park, public hunting shall be allowed on public lands in that
portion of the addition under paragraph (a) that lies north of
Minnesota trunk highway No. 61.
Subd. 3. [85.012] [Subd. 17.] [FORT RIDGELY STATE PARK,
NICOLLET AND RENVILLE COUNTIES.] The following areas are added
to Fort Ridgely state park, all in Township 112 North, Range 32
West, Renville county:
(1) the South Half of the Southwest Quarter of Section 29;
(2) the North Half of the Southeast Quarter, the Southeast
Quarter of the Southeast Quarter, and the Southwest Quarter of
the Southeast Quarter of Section 30, excepting that part of said
Southwest Quarter of the Southeast Quarter described as follows:
Beginning at the southwest corner of said Southeast Quarter of
Section 30; thence on an assumed bearing of East along the south
line of said Section 30 a distance of 250 feet; thence northerly
along a line parallel to the east line of said Southeast
Quarter, a distance of 872 feet; thence westerly along a line
parallel to the south line of said Southeast Quarter, a distance
of 250 feet, thence southerly along a line parallel to the east
line of said Southeast Quarter, a distance of 872 feet to the
point of beginning;
(3) the Northeast Quarter of the Northeast Quarter, the
North Half of the Southwest Quarter, and the North Half of the
South Half of the Southwest Quarter of Section 31; and
(4) the North Half of the Northwest Quarter of Section 32.
Subd. 4. [85.012] [Subd. 19.] [FORESTVILLE MYSTERY CAVE
STATE PARK, FILLMORE COUNTY.] The following area is added to
Forestville Mystery Cave state park, all in Section 14, Township
102 North, Range 12 West, Fillmore county: That part of the
Southeast Quarter of the Southeast Quarter of Section 14
described as follows: Beginning at a point on the east line of
the Southeast Quarter of Section 14 a distance of 15.25 chains
North of the southeast corner thereof; thence South 15.25 chains
to said corner; thence West 6.25 chains; thence North 18 chains;
thence South 69 1/2 degrees East to the place of beginning.
Subd. 5. [85.012] [Subd. 34.] [LAKE BRONSON STATE PARK,
KITTSON COUNTY.] The following area is added to Lake Bronson
state park, Kittson county: all of Section 4, Township 160
North, Range 46 West.
Subd. 6. [85.012] [Subd. 38.] [LAKE SHETEK STATE PARK,
MURRAY COUNTY.] The following area is added to Lake Shetek state
park, all in Section 32, Township 108 North, Range 40 West,
Murray county: That part of Sublots 1 and 2 of Government Lot
4, lying westerly of the following described line: Commencing
at the south quarter corner of said Section 32; thence on an
assumed bearing of West along the south line of said Section 32
a distance of 439.20 feet to the point of beginning; thence
North 00 degrees 23 minutes 26 seconds East 1164.26 feet along
the center line of an existing road; thence North 41 degrees 07
minutes 40 seconds West 468.30 feet along the center line of an
existing road; thence North 48 degrees 27 minutes 52 seconds
West 114.73 feet along the center line of an existing road;
thence South 66 degrees 19 minutes 52 seconds West 60.70 feet;

Subd. 7. [85.012] [Subd. 45.] [NERSTRAND BIG WOODS STATE
PARK, RICE COUNTY.] The following area is added to Nerstrand Big
Woods state park, all in Township 110 North, Range 19 West, Rice
county: The West Half of the Northwest Quarter of the Southwest
Quarter of Section 3 and the North Half of the Southeast Quarter
of Section 4; EXCEPTING THEREFROM: Beginning at the northwest
corner of the Northwest Quarter of the Southwest Quarter of said
Section 3; thence East 231.0 feet; thence South 43 rods; thence
West 24 rods; thence North 17 rods; thence East 3 rods; thence
North 26 rods to the north line of the Southeast Quarter of said
Section 4; thence East 7 rods to the place of beginning.
Subd. 8. [85.012] [Subd. 54.] [SPLIT ROCK LIGHTHOUSE STATE
PARK, LAKE COUNTY.] The following areas are added to Split Rock
state park, all in Township 55 North, Range 8 West, Lake county:
(1) that part of the Northwest Quarter of the Southeast
Quarter of Section 32 lying north and west of the centerline of
Minnesota trunk highway No. 61;
(2) that part of Government Lots 2 and 3 of Section 28
lying westerly of Minnesota Department of Transportation
right-of-way plat number 38-2 as the same is on file and of
record in the office of the county recorder and the register of
titles, in and for Lake county, Minnesota, as Torrens Document
No. 19231;
(3) Outlot 3 of Government Lot 2 of Section 33; and
(4) the SE1/4 of the SE1/4 of Section 31.
Sec. 4. [ADDITIONS TO STATE RECREATION AREAS.]
Subdivision 1. [85.013] [Subd. 2c.] [BIG BOG STATE
RECREATION AREA, BELTRAMI COUNTY.] (a) The following area is
added to Big Bog state recreation area, Beltrami county: That
part of the Northwest Quarter of the Southwest Quarter lying
west of the Tamarac river, all in Section 9, Township 154 North,
Range 30 West.
(b) The commissioner of natural resources shall manage the
state recreation area according to Minnesota Statutes, section
86A.05, subdivision 3, and in addition to other activities
authorized in the state recreation area, portions of the
northern unit of Big Bog state recreation area shall be open to
hunting and trapping activities as described in the state
recreation area management plan.
Subd. 2. [85.013] [Subd. 11a.] [GARDEN ISLAND STATE
RECREATION AREA, LAKE OF THE WOODS COUNTY.] The following area
is added to Garden Island state recreation area, Lake of the
Woods county: All that part of Government Lot 1, Section 36,
Township 167 North, Range 33 West, Little Oak Island, that lies
northerly of a line as defined by Marker A now in place on the
west shore of said Lot 1 and Marker B now in place on the east
shore of said Lot 1 (said monuments or markers being the
identical Marker A and Marker B that were described in a certain
CORRECTED CONTRACT FOR DEED that was filed for record in Book
49, page 177) and the northeasterly and southwesterly extensions
of said line, said Marker A lies 938.23 feet due North, and
1011.81 feet due West of the center 1/4 corner of said Section
36. Marker B bears North 67 degrees 15 minutes 17 seconds East
a distance of 535.96 feet from said Marker A.
Sec. 5. [DELETION FROM BIG BOG STATE RECREATION AREA.]
[85.013] [Subd. 2c.] [BIG BOG STATE RECREATION AREA,
BELTRAMI COUNTY.] The following area is deleted from Big Bog
state recreation area, Beltrami county: That part of Government
Lot 1 of Section 8, Township 154 North, Range 30 West, lying
westerly of state trunk highway No. 72 and northerly of the
Tamarac river.
Sec. 6. [DELETION FROM CROW WING STATE PARK.]
[85.012] [Subd. 14.] [CROW WING STATE PARK, CROW WING
COUNTY.] The following area is deleted from Crow Wing state
park, all in Township 44 North, Range 32 West, Crow Wing county:
That part of the Southeast Quarter of the Southwest Quarter of
Section 25 lying southeasterly of the northwesterly right-of-way
line of Minnesota trunk highway No. 371.
Sec. 7. [REDESCRIBING GEORGE H. CROSBY MANITOU STATE PARK
BOUNDARIES.]
[85.012] [Subd. 22.] [GEORGE H. CROSBY MANITOU STATE PARK,
LAKE COUNTY.] (a) Notwithstanding any other law, including Laws
1955, chapter 144, George H. Crosby Manitou state park,
heretofore established, shall consist of the following described
lands, all in Lake county:
(1) the Southwest Quarter of the Southwest Quarter of
Section 2; the Northwest Quarter, the West Half of the Southeast
Quarter, the North Half of the Southwest Quarter, and the
Southeast Quarter of the Southwest Quarter of Section 3; all in
Township 57 North, Range 6 West;
(2) the Southwest Quarter of the Northwest Quarter and the
Southwest Quarter of Section 14; the Southeast Quarter of the
Northeast Quarter, the Southwest Quarter of the Northwest
Quarter, and the South Half of Section 15; that part of the
Southeast Quarter of the Northeast Quarter and that part of the
South Half lying southerly and easterly of Lake county road No.
7 of Section 17; that part of the East Half and that part of the
Southwest Quarter lying easterly of Lake county road No. 7 of
Section 20; all of Sections 21 and 22; the Southwest Quarter of

(b) The commissioner shall manage the state park as
provided in Minnesota Statutes, section 86A.05, subdivision 3,
but in addition to other activities authorized in George H.
Crosby Manitou state park, shall allow public hunting in that
portion of the park lying east of the Manitou river and north of
Minnesota trunk highway No. 61.
(c) Notwithstanding Minnesota Statutes, section 85.012,
subdivision 1, tax-forfeited land located within George H.
Crosby Manitou state park is not withdrawn from sale and is not
transferred from the custody, control, and supervision of the
county board.
