An act relating to insurance; clarifying that existing
law prohibits insurers from terminating agents as a
result of contacts with any branch of government;
amending Minnesota Statutes 1994, section 72A.20,
subdivision 20.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1. Minnesota Statutes 1994, section 72A.20,
subdivision 20, is amended to read:
Subd. 20. [CONTACT WITH DEPARTMENT GOVERNMENT.] An
insurance company may not terminate or otherwise penalize an
insurance agent solely because the agent contacted any
government department or agency regarding a problem that the
agent or an insured may be having with an insurance
company. For purposes of this section, "government department
or agency" includes the executive, legislative, and judicial
branches of government as stated in article III of the
Constitution.
Sec. 2. [EFFECTIVE DATE.]
Section 1 is a clarification of the legislature's intent in
originally enacting Minnesota Statutes, section 72A.20,
subdivision 20, and section 1 is therefore effective
retroactively to May 18, 1989, which was the effective date of
that statute as originally enacted.
