An act relating to local government; permitting the
city of Hutchinson to incur debt for certain
improvements; authorizing a reverse referendum on the
issuance of city bonds.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1. [BONDS.]
The city of Hutchinson may issue general obligation bonds
of the city in an amount not to exceed $1,500,000 for its share
of a tri-agency maintenance facility with McLeod county, and the
state department of transportation, without election under
Minnesota Statutes, chapter 475, or city charter, on the
question of issuance of the bonds or a tax to pay them except as
provided in this act. The debt represented by the bonds must
not be included in computing any debt limits applicable to the
city of Hutchinson, and the levy of taxes required by section
475.61 to pay principal of and interest on the bonds is not
subject to any levy limit and must not be included in computing
or applying any levy limit applicable to the city. Except as
otherwise provided in this act, the city must comply with the
provisions of Minnesota Statutes, chapter 475, in exercising the
authority granted in this act.
Sec. 2. [LOCAL APPROVAL.]
(a) Section 1 is effective without local approval unless
the voters of the city of Hutchinson request a referendum on
approval of the authority granted in section 1 by June 30, 1994.
(b) The voters may request a referendum by filing a
petition with the governing body of the city of Hutchinson. The
petition must state the text of section 1 and indicate that
those who signed the petition are residents of the city of
Hutchinson and are 18 years of age or older. The petition must
be signed by a number of persons equal to ten percent or more of
the number of persons who cast votes for governor within the
city of Hutchinson at the last general election for governor.
