An act relating to agriculture; exempting certain
nonprofit organizations from the requirement for a
nursery stock dealer certificate; proposing coding for
new law in Minnesota Statutes, chapter 18.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1. [18.525] [EXEMPT SALES.]
An organization does not need to obtain a nursery stock
dealer certificate before offering certified nursery stock for
sale or distribution if the organization:
(1) is a nonprofit charitable, educational, or religious
organization;
(2) conducts sales or distributions of certified nursery
stock on 14 or fewer days in a calendar year; and
(3) uses the proceeds from its nursery stock sales or
distributions for charitable, educational, or religious purposes.
The organization must notify the commissioner, prior to any
sales or distributions of certified nursery stock and must
demonstrate to the commissioner, if requested, that such sales
or distributions will be conducted on 14 or fewer days in the
calendar year, as provided in clause (2).
Sec. 2. [EFFECTIVE DATE.]
This act is effective the day following final enactment.
