An act relating to utilities; prohibiting state
permits for construction of certain hydropower
facilities on the bluffs of the Mississippi river;
proposing coding for new law in Minnesota Statutes,
chapter 216B.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1. [216B.245] [PUMP AND STORE HYDROPOWER
FACILITIES; PROHIBITION.]
A state agency may not issue a permit for the construction
of a facility for generating electricity if the facility would
be located on top of the bluffs along the Mississippi river and
would pump water from any portion of the river, store the water
on top of the bluffs, and release the water at a later time to
generate the electricity.
Sec. 2. [EFFECTIVE DATE.]
Section 1 is effective the day following final enactment.
