CHAPTER 138-H.F.No. 1408
An act relating to agriculture; redefining terms in
the plant pest act; exempting certain nonprofit
organizations from the requirement for a nursery stock
dealer certificate; amending Minnesota Statutes 1992,
section 18.46, subdivision 3, and by adding a
subdivision; proposing coding for new law in Minnesota
Statutes, chapter 18.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1. Minnesota Statutes 1992, section 18.46,
subdivision 3, is amended to read:
Subd. 3. Nursery stock: Nursery stock includes: all
hardy deciduous and evergreen trees, shrubs, vines, and other
plants having a persistent woody stem; all hardy herbaceous
perennials;, whether wild or cultivated, and parts of either of
those thereof which are for and capable of propagation.
Sec. 2. Minnesota Statutes 1992, section 18.46, is amended
by adding a subdivision to read:
Subd. 3a. [HARDY.] "Hardy" describes a plant that can
survive the normal winters in Minnesota without artificial
protection.
Sec. 3. [18.525] [EXEMPT SALES.]
An organization does not need to obtain a nursery stock
dealer certificate before offering nursery stock for sale or
distribution if the organization:
(1) is a nonprofit charitable, educational, or religious
organization;
(2) conducts sales or distributions of nursery stock on ten
or fewer days in a calendar year; and
(3) uses the proceeds from its nursery stock sales or
distributions for charitable, educational, or religious purposes.
