CHAPTER 473-S.F.No. 2355
An act relating to the cities of Bloomington and West
St. Paul; authorizing the city to expend and loan
public funds for flood mitigation measures to protect
residential structures.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1. [DEFINITIONS.]
For purposes of sections 1 to 3:
(1) "Flood mitigation measures" means structural or
nonstructural alterations to buildings or to the underlying
parcels which will tend to prevent or limit flooding of the
buildings or to mitigate the effects of flooding.
(2) "Residential structures" means both single-family and
multiple-family residences.
(3) "Flood-prone areas" means the floodplain zones of the
city, and other areas of the city which, because of their
location, topography, or other circumstances, tend to be subject
to recurrent flooding during heavy rainfalls or other climatic
conditions.
Sec. 2. [AUTHORIZATION.]
The cities of Bloomington and West St. Paul may expend or
loan public funds for flood mitigation measures to protect
residential structures lying within its flood-prone areas.
Sec. 3. [DEBT.]
Flood mitigation measures are a public purpose for which
the cities of Bloomington and West St. Paul may incur debt in
accordance with Minnesota Statutes, chapter 475.
Sec. 4. [EFFECTIVE DATE.]
This act takes effect for the city of Bloomington the day
following compliance with Minnesota Statutes, section 645.121,
subdivision 3, by the Bloomington city council. This act takes
effect for the city of West St. Paul the day following
compliance with Minnesota Statutes, section 645.021, subdivision
3, by the West St. Paul city council.
