An act relating to state government; changing certain
procedures related to the state archaeologist and
archaeologic sites; amending Minnesota Statutes 1984,
sections 138.35, subdivision 1; and 138.40,
subdivision 3.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1. Minnesota Statutes 1984, section 138.35,
subdivision 1, is amended to read:
Subdivision 1. [APPOINTMENT.] The state archaeologist
shall be a professional archaeologist who is not employed by the
Minnesota historical society and shall be appointed by the board
of the Minnesota historical society in consultation with the
Indian affairs council for a four-year term.
Sec. 2. Minnesota Statutes 1984, section 138.40,
subdivision 3, is amended to read:
Subd. 3. When significant archaeological or historic sites
are known or suspected to exist on public lands or waters, the
agency or department controlling said lands or waters shall
submit construction or development plans to the state
archaeologist, and the director of the society for review at
prior to the time bids are advertised. The state archaeologist
and the society shall promptly review such plans and make
recommendations for the preservation of archaeological or
historic sites which may be endangered by construction or
development activities. When archaeological or historic sites
are related to Indian history or religion, the Indian affairs
council must be afforded the opportunity to review and recommend
action.
