An act relating to natural resources; authorizing the
commissioner of natural resources to sell certain
lands in St. Louis county.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1. [CONVEYANCE OF STATE LAND; ST. LOUIS COUNTY.]
Subdivision 1. [AUTHORIZATION.] Notwithstanding Minnesota
Statutes, section 92.45, the commissioner of natural resources
may offer for sale and sell, in the manner provided for the sale
of other trust fund lands, the land described in subdivision 3,
except that the value of the improvements on the land shall be
appraised separately. The conveyance must be in a form approved
by the attorney general.
Subd. 2. [CONDITIONS OF SALE.] (a) If at the sale of the
land Charles Neuenschwander is the purchaser, he is not required
to pay for the improvements upon furnishing an affidavit showing
that the improvements were paid by him.
(b) If a person other than Charles Neuenschwander purchases
the land, the purchaser shall pay in cash to the state at the
time of sale, in addition to all required payments, the full
amount for which improvements are appraised. The amount
received by the state for the improvements shall be paid by the
state treasurer, with the approval of the commissioner of
finance, to Charles Neuenschwander or his successor in interest
as compensation for the improvements. The moneys required for
the payment are appropriated for this purpose.
Subd. 3. [LAND DESCRIPTION.] The commissioner may offer
for sale and sell the land described as: that part of
government lot one of section seven, township sixty-nine north,
range twenty-one west, St. Louis county, Minnesota, described as
follows: beginning at the northwest corner of said government
lot one; thence on an assumed bearing of south 88 degrees 09'
58" east, 25.00 feet along the north line thereof; thence South
01 degree 07' 00" west, 349 feet, more or less, to the water's
edge of Kabetogama Lake; thence westerly 25 feet, more or less,
along said water's edge to the west line of said government lot
one; thence north 00 degrees 12' 43" east, 358 feet, more or
less, along said west line to the point of beginning; containing
0.2 acres, more or less.
Subd. 4. [REASON FOR SALE.] A resort cabin was
inadvertently built on this state property in the 1940s and has
been owned, occupied, and improved since it was built.
Sec. 2. [EFFECTIVE DATE.]
Section 1 is effective the day following final enactment.
