GENERAL RULES OF PRACTICE

Rule 523.Procedure in District Court

Except as otherwise expressly provided in these rules, proceedings in the district court are governed by the Minnesota Rules of Civil Procedure and the General Rules of Practice for the District Courts. The judge who presided in conciliation court must not preside in district court.

1993 Committee Comment

The Minnesota Supreme Court has determined that a corporation must be represented by a licensed attorney when appearing in district court regardless of the fact that the action originated in conciliation court. Nicollet Restoration, Inc. v. Turnham, 486 N.W.2d 753 (Minnesota 1992).

Advisory Committee Comment - 2026 Amendments

Rule 523 has been amended as part of a comprehensive set of changes to the conciliation court rules in 2026 to use plain language and improve clarity.
