A bill for an act
relating to public health; expanding prohibition of bisphenol-A in products
for young children; amending Minnesota Statutes 2010, sections 325F.172,
subdivision 3; 325F.173.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2010, section 325F.172, subdivision 3, is amended to
read:


Subd. 3.

Children's product.

"Children's product" means an empty bottle or cup
to be filled with food or liquid that is designed or intended by a manufacturer to be used
by a childnew text begin , or a food container that is commercially available and contains food or liquid
designed or intended by the manufacturer to be consumed by a child

Sec. 2.

Minnesota Statutes 2010, section 325F.173, is amended to read:


325F.173 BISPHENOL-A IN CERTAIN CHILDREN'S PRODUCTS.

(a) By January 1, 2010, no manufacturer or wholesaler may sell or offer for sale in
this state a children's product that contains bisphenol-A.

(b) This section does not apply to sale of a used children's product.

(c) By January 1, 2011, no retailer may sell or offer for sale in this state a children's
product that contains bisphenol-A.

new text begin (d) Manufacturers must not replace bisphenol-A with carcinogens rated by the
United States Environmental Protection Agency as A, B, or C carcinogens or substances
listed on the Environmental Protection Agency's "List of Chemicals Evaluated for
Carcinogenic Potential" as known or likely carcinogens, known to be human carcinogens,
likely to be human carcinogens, or suggestive of being carcinogens.

United States Environmental Protection Agency has identified as causing birth defects,
reproductive harm, or developmental harm.
