relating to higher education; providing for the use of student data; proposing
coding for new law in Minnesota Statutes, chapter 136A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin When any institution of higher education provides the Office of Higher Education,
Department of Education, or any other state agency student data or records, the institution
of higher education shall not be liable for any breach of confidentiality, disclosure, use,
retention, or destruction of such student data or records, if the breach, disclosure, use,
retention, or destruction of the records resulted from actions or omissions of:

new text begin (1) the Office of Higher Education, Department of Education, or any other state
agency; or

new text begin (2) individuals or entities provided access to the education records by the Office of
Higher Education, the Department of Education, or any other state agency.
