  1.1                          A bill for an act
  1.2             relating to transportation; creating surface 
  1.3             transportation fund; dedicating motor vehicle sales 
  1.4             tax revenues to transportation; proposing an amendment 
  1.5             to the Minnesota Constitution by adding a section to 
  1.6             article XIV; proposing coding for new law in Minnesota 
  1.7             Statutes, chapter 174. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  [174.40] [SURFACE TRANSPORTATION FUND.] 
  1.10     Subdivision 1.  [FUND CREATED.] A surface transportation 
  1.11  fund is created in the state treasury.  The fund consists of all 
  1.12  money appropriated or credited to the fund by law. 
  1.13     Subd. 2.  [EXPENDITURES FROM FUND.] Money in the surface 
  1.14  transportation fund may be expended by appropriation for costs 
  1.15  related to any state surface transportation purpose, including, 
  1.16  but not limited to:  operating and capital assistance to 
  1.17  transit, rail, and waterway systems; and construction, 
  1.18  improvement, and maintenance of public highways. 
  1.19     Sec. 2.  [CONSTITUTIONAL AMENDMENT PROPOSED.] 
  1.20     An amendment is proposed to the Minnesota Constitution, 
  1.21  article XIV.  If the amendment is adopted, the title of article 
  1.22  XIV will be "TRANSPORTATION" and article XIV will be amended by 
  1.23  adding a section to read: 
  1.24     Sec. 12.  The legislature shall appropriate in each fiscal 
  1.25  year for state surface transportation needs a minimum of 25 
  1.26  percent of the net proceeds from a sales or excise tax imposed 
  2.1   by law on the purchase price of new and used vehicles. 
  2.2      Sec. 3.  [SUBMISSION TO VOTERS.] 
  2.3      The constitutional amendment proposed in section 2 must be 
  2.4   submitted to the people at the 1998 general election.  The 
  2.5   question submitted must be: 
  2.6      "Shall the Minnesota Constitution be amended to require 
  2.7   that the legislature annually appropriate for state surface 
  2.8   transportation needs at least 25 percent of net proceeds from 
  2.9   the sales tax on new and used motor vehicles? 
  2.10                                     Yes .......
  2.11                                     No ........"
