  1.1                          A bill for an act 
  1.2             relating to the environment; modifying septic system 
  1.3             tank fees; amending Minnesota Statutes 2003 
  1.4             Supplement, section 115.551. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2003 Supplement, section 
  1.7   115.551, is amended to read: 
  1.8      115.551 [TANK FEE.] 
  1.9      (a) An installer A septic permitting authority shall pay a 
  1.10  fee of $25 for each septic system tank installed in the previous 
  1.11  calendar year.  The fees required under this section must be 
  1.12  paid to the commissioner by January 30 of each year.  The 
  1.13  revenue derived from the fee imposed under this section shall be 
  1.14  deposited in the environmental fund and is exempt from section 
  1.15  16A.1285. 
  1.16     (b) A county may charge an additional fee of up to $5 over 
  1.17  the fee in paragraph (a) in order to fulfill the requirements of 
  1.18  Minnesota Rules, chapter 7080.
