  1.1                          A bill for an act 
  1.2             relating to agriculture; requiring certain milk 
  1.3             products to be labeled; amending Minnesota Statutes 
  1.4             2002, section 32.75, subdivision 2. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2002, section 32.75, 
  1.7   subdivision 2, is amended to read: 
  1.8      Subd. 2.  [VOLUNTARY LABELING.] (a) Products offered for 
  1.9   wholesale or retail sale in this state which contain milk, 
  1.10  cream, or any product or by-product of milk or cream, which have 
  1.11  been processed and handled pursuant to the requirements of this 
  1.12  section, may be labeled:  "Milk in this product is from cows not 
  1.13  treated with rBGH."  Labeling of dairy products under this 
  1.14  section which are offered for sale within this state may also 
  1.15  include an indication that the milk used is "farmer certified 
  1.16  rBGH-free."  Products offered for wholesale or retail sale in 
  1.17  this state need not contain any further label information 
  1.18  relative to the use of rBGH in milk production. 
  1.19     (b) The label described in paragraph (a) may appear on the 
  1.20  principal display panel, as defined in section 31.01, 
  1.21  subdivision 22, of a packaged product, be conspicuously attached 
  1.22  to the container of a bulk product, or appear in any 
  1.23  advertisement, as defined in section 31.01, subdivision 26, for 
  1.24  a product, including media advertising, or displays or placards 
  1.25  posted in retail stores. 
  2.1      Sec. 2.  [REQUIRED LABELING.] 
  2.2      (a) Products offered for wholesale or retail sale in this 
  2.3   state containing milk, cream, or any product or by-product of 
  2.4   milk or cream that was produced from cows treated with rBGH must 
  2.5   be labeled:  "Milk in this product is from cows that have been 
  2.6   treated with rBGH." 
  2.7      (b) The label must appear on the principal display panel as 
  2.8   defined in Minnesota Statutes, section 31.01, subdivision 22, of 
  2.9   a packaged product, be conspicuously attached to the container 
  2.10  of a bulk product, and must appear in any advertisement, as 
  2.11  defined in Minnesota Statutes, section 31.01, subdivision 26, 
  2.12  for a product, including media advertising, or displays or 
  2.13  placards posted in retail stores.
