  1.1                          A bill for an act
  1.2             relating to traffic regulations; specifying duty of 
  1.3             care of bus drivers to passengers; proposing coding 
  1.4             for new law in Minnesota Statutes, chapter 169. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [169.2212] [BUS DRIVER DUTY OF CARE.] 
  1.7      The duty of care owed by a driver of a regular route 
  1.8   transit bus to a passenger on that bus, including a passenger 
  1.9   who is either an elementary or a secondary pupil, applies only 
  1.10  when the passenger is on the bus or boarding or disembarking.  
  1.11  The duty of care owed by a driver of a paratransit vehicle to a 
  1.12  passenger on that vehicle, including a passenger who is either 
  1.13  an elementary or a secondary pupil, applies only when the 
  1.14  passenger is on the vehicle or boarding or disembarking, and as 
  1.15  provided in the local passenger assistance policy.  Boarding or 
  1.16  disembarking is the process of boarding or disembarking and 
  1.17  includes a duty to use reasonable care to provide and select a 
  1.18  reasonably safe bus stop from which to board or disembark.  At 
  1.19  all other times the passenger is a pedestrian and a driver's 
  1.20  duty is limited to the duty of care owed by an operator of a 
  1.21  motor vehicle to a pedestrian.  For purposes of this section, 
  1.22  "regular route transit" has the meaning given it in section 
  1.23  174.22, subdivision 8, and "paratransit" has the meaning given 
  1.24  it in section 174.22, subdivision 6.
