  1.1                          A bill for an act 
  1.2             relating to human services; clarifying and suspending 
  1.3             certain rates imposed on intermediate care facilities. 
  1.4   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.5      Section 1.  [RATE CLARIFICATION.] 
  1.6      For the rate year beginning October 1, 1996, the 
  1.7   commissioner of human services shall exempt ICF/MR facilities 
  1.8   from reductions to the payment rates under Minnesota Statutes, 
  1.9   section 256B.501, subdivision 5b, if the facility is an A to B 
  1.10  licensure conversion project that has been converted under 
  1.11  Minnesota Statutes, section 252.292, since rate year 1990.  For 
  1.12  purposes of the rate year beginning October 1, 1995, the 
  1.13  commissioner shall retroactively adjust rates for converted 
  1.14  facilities to reflect the exemption from rate penalties in 
  1.15  Minnesota Statutes, section 256B.501, subdivision 5b, paragraph 
  1.16  (d), clause (8). 
  1.17     Sec. 2.  [RATE SUSPENSION.] 
  1.18     Notwithstanding Minnesota Statutes, section 256B.501, 
  1.19  subdivision 3a, the commissioner of human services shall suspend 
  1.20  use of the case mix assessment as a basis for determining 
  1.21  facility rates for ICF/MR, until such time as the assessment 
  1.22  methodology has been subject to notice and hearing and has been 
  1.23  determined to be reasonable pursuant to Minnesota Statutes, 
  1.24  chapter 14.
