  1.1                          A bill for an act 
  1.2             relating to health; modifying health care service 
  1.3             contract requirements; amending Minnesota Statutes 
  1.4             1998, section 62R.06, subdivision 1. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1998, section 62R.06, 
  1.7   subdivision 1, is amended to read: 
  1.8      Subdivision 1.  [PROVIDER CONTRACTS.] A health provider 
  1.9   cooperative and its licensed members may execute marketing and 
  1.10  service contracts requiring the provider members to provide some 
  1.11  or all of their health care services through the provider 
  1.12  cooperative to the enrollees, members, subscribers, or insureds, 
  1.13  of a health care network cooperative, community integrated 
  1.14  service network, nonprofit health service plan, health 
  1.15  maintenance organization, accident and health insurance company, 
  1.16  or any other purchaser, including the state of Minnesota and its 
  1.17  agencies, instruments, or units of local government.  Each 
  1.18  purchasing entity is authorized to execute contracts for the 
  1.19  purchase of health care services from a health provider 
  1.20  cooperative in accordance with this section.  Any contract 
  1.21  between a provider cooperative and a purchaser must provide for 
  1.22  payment by the purchaser to the health provider cooperative on a 
  1.23  substantially capitated or similar risk-sharing basis.  Each 
  1.24  contract between a provider cooperative and a purchaser shall be 
  1.25  filed by the provider network cooperative with the commissioner 
  2.1   of health and is subject to the provisions of section 62D.19.
