A bill for an act
relating to the environment; requiring an environmental impact statement for
atrazine, chlorpyrifos, and acetochlor; appropriating money.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin ENVIRONMENTAL IMPACT STATEMENT; ATRAZINE,
CHLORPYRIFOS, AND ACETOCHLOR; APPROPRIATION.

new text begin (a) The Environmental Quality Board shall conduct an environmental impact
statement, under Minnesota Statutes, section 116D.04, on the use of atrazine, chlorpyrifos,
and acetochlor in the state.

new text begin (b) Notwithstanding Minnesota Statutes, section 16A.1283, the commissioner
of agriculture shall determine and collect an adequate surcharge on the registration of
atrazine, chlorpyrifos, and acetochlor, under Minnesota Statutes, section 18B.26, to
pay all costs of the environmental impact statement required under paragraph (a). The
surcharge is exempt from the rulemaking provisions of Minnesota Statutes, chapter
14, and Minnesota Statutes, section 14.386, does not apply. Money collected from the
surcharge shall be deposited into the pesticide regulatory account in the agricultural fund.

required under paragraph (a) is appropriated from the pesticide regulatory account in the
agricultural fund to the Environmental Quality Board.
