  1.1                          A bill for an act 
  1.2             relating to the environment; removing the commissioner 
  1.3             of the pollution control agency as a member of the 
  1.4             agency board; amending Minnesota Statutes 1995 
  1.5             Supplement, section 116.02, subdivisions 1, 3, and 4. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1995 Supplement, section 
  1.8   116.02, subdivision 1, is amended to read: 
  1.9      Subdivision 1.  A pollution control agency, designated as 
  1.10  the Minnesota pollution control agency, is hereby created.  The 
  1.11  agency shall consist of the commissioner and eight nine members 
  1.12  appointed by the governor, by and with the advice and consent of 
  1.13  the senate.  One of such members shall be a person knowledgeable 
  1.14  in the field of agriculture. 
  1.15     Sec. 2.  Minnesota Statutes 1995 Supplement, section 
  1.16  116.02, subdivision 3, is amended to read: 
  1.17     Subd. 3.  The membership of the pollution control agency 
  1.18  shall be broadly representative of the skills and experience 
  1.19  necessary to effectuate the policy of sections 116.01 to 
  1.20  116.075, except that no member other than the commissioner shall 
  1.21  be an officer or employee of the state or federal government.  
  1.22  Only two members at one time may be officials or employees of a 
  1.23  municipality or any governmental subdivision, but neither may be 
  1.24  a member ex officio or otherwise on the management board of a 
  1.25  municipal sanitary sewage disposal system. 
  2.1      Sec. 3.  Minnesota Statutes 1995 Supplement, section 
  2.2   116.02, subdivision 4, is amended to read: 
  2.3      Subd. 4.  The commissioner shall serve as chair of the 
  2.4   agency.  The agency shall elect a chair and such other officers 
  2.5   as it deems necessary.
