A bill for an act
relating to retirement; permitting the Hopkins Volunteer Firefighter Relief
Association to allow a deferred member to apply for a disability benefit for
a non-duty-related disability.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin HOPKINS VOLUNTEER FIREFIGHTER RELIEF ASSOCIATION;
DISABILITY BENEFIT.

new text begin (a) Notwithstanding any provision of Minnesota Statutes, chapter 424A, to the
contrary, the Hopkins Volunteer Firefighter Relief Association may amend its bylaws:

new text begin (1) to define a non-duty-related total and permanent disability applicable to a
deferred relief association member; and
new text end

new text begin (2) to permit an eligible person defined in paragraph (b) who meets the eligibility
requirements of its bylaws for a deferred member nonduty total and permanent disability
benefit, upon written application, to receive a disability benefit.

new text begin (b) An eligible person is a person who:
new text end

new text begin (1) was born on January 17, 1970;
new text end

new text begin (2) became an active member of the Hopkins Fire Department on April 7, 1988; and
new text end

new text begin (3) elected to become a deferred member of the Hopkins Fire Department on July
7, 2005.

new text begin (c) A nonduty total and permanent disability benefit for a deferred relief association
member under this section:
new text end

new text begin (1) may not exceed in total the amount of any vested deferred service pension amount;
new text end

new text begin (2) is payable one-half in the calendar year in which the disability benefit application
is filed, and one-half in the calendar year next following the calendar year in which the
disability benefit application is filed; and

new text begin (3) upon application filing, is in lieu of any other pension or benefit from the relief
association special fund.

new text begin (d) Upon the October 1 next following the effective date of this section, if the Hopkins
Volunteer Firefighter Relief Association amends its bylaws as provided in paragraph (a),
clause (1), and if the eligible person applies for the disability benefit under paragraph
(a), clause (2), accompanying the fire state aid and police and firefighter retirement
supplemental state aid payable on that date, the commissioner of revenue shall also pay
the Hopkins Volunteer Firefighter Relief Association an additional equal amount as an
advance of the state aid payable to the city of Hopkins in the next following calendar year.

the date on which the Hopkins city council and the Hopkins chief clerk timely complete
their compliance with Minnesota Statutes, section 645.021, subdivisions 2 and 3.
