A bill for an act
relating to education; authorizing a school board to
levy for the difference between the maximum levy
certified by the commissioner of education and the
maximum levy quoted by the commissioner; proposing
coding for new law in Minnesota Statutes, chapter 126C.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Notwithstanding section 275.74, if the maximum levy quoted
by the commissioner of education to a school district was
greater than the maximum levy certified by the commissioner, the
district may levy the difference, provided that the quoted
maximum levy amount was made in error resulting from
calculations made by the Department of Education and not as a
result of the data provided by the school district to the
Department of Education.

The difference levy is the amount equal to the maximum levy
amount quoted by the commissioner of education minus the maximum
levy certified by the commissioner, but not less than zero.

This section is effective for revenue for
fiscal year 2007 and later.
